Real Portraits Terms & COnditions


BY BOOKING OR ORDERING PHOTOGRAPHIC WORKS WITH STACEY CAVALIER PHOTOGRAPHY, YOU AGREE TO THESE TERMS AND CONDITIONS.


The Photographer - Stacey Cavalier Photography.

The Client - the person agreeing to this contract and making the booking (in cases where the Participant is under 16 years old, this would be the parent/guardian, who then takes full responsibility for the terms and conditions of this contract being met by themselves and The Participant).

The Participant - the person being photographed (this maybe the Client, or may not, if the person under 16 years old).

Photographic Works - digital images, video, audio, printed work, or products created and/or provided by The Photographer (Stacey Cavalier Photography).


  • NZIPP Terms and Conditions
  • As a member of NZIPP, Stacey Cavalier Photography (The Photographer) works in accordance with the NZIPP Standard Photographic Terms and Conditions of Engagement. These form part of this agreement and can be read here:

  • Booking, Postponements and Cancellations
  • The booking fee must be fully paid to confirm your booking.
  • The booking fee covers your session, preparation of an online gallery of images for you to choose from, and 3 fully edited, black and white, high resolution digital files for you to download.
  • The booking fee is non-refundable. If you are unable to attend due to sickness and have notified The Photographer prior to your session, your booking fee may be transferred to a new date, for the next available sessions. You can only transfer a booking fee once.
  • If you do not advise The Photographer that you are unable to attend, prior to the start of the session, your booking fee will be forfeited and you will need to pay a new booking fee to book a new session.
  • If the session cannot go ahead (e.g. The Photographer is sick) you will be notified and given the option to transfer your booking fee to a new date, or to a full refund of monies paid.


  • The Session
  • The session will run for up to 15 minutes and is for 1 person only (unless otherwise stated).
  • Please arrive 5 minutes prior to the start of the session. As sessions run back to back, late arrival will reduce the session time.
  • No cameras or recording devices are to be used during the session.
  • It is ideal for parents/guardians to be remain seated in the waiting area whilst the session takes place, but they can be admitted to the studio if your kid prefers.
  • Please ensure that you/your kids are presented as you would like to be seen in your photographs e.g. children's faces clean, hair brushed, clothes clean and crease free etc.


  • The Gallery
  • An online, password protected, edited gallery will be ready to view within 3 - 4 weeks of your session taking place.
  • When the gallery is ready, you will be notified that a link to gallery is coming in the next 24 - 48 hours. If you are unable to access the gallery (e.g. holiday/personal circumstances) you can email The Photographer to arrange for the link to be sent at a more convenient time, however, all orders must take place within 4 weeks of being advised that the gallery is ready. After this time the gallery will be archived.
  • Once the link is sent, the gallery will be online for 3 days, during which you will choose and download your 3 digital images included in the booking. If you wish to order extra digital photos or printed items, you must also do this then.


  • Orders & Downloads
  • All digital downloads are final and cannot be refunded or exchanged, so please choose carefully.
  • Any additional digital photos or printed products ordered, must be fully paid for at the time of ordering. Again, due to their unique nature, all orders are final and cannot be altered, exchanged or refunded.
  • Printed products are usually available for collection/posting within 6 - 8 weeks of the order. You will be advised when they are ready.
  • Delays in payment or communication with the Photographer will result in the order being put on hold, and delays in final delivery.


  • Editing of Images, Storage of Files, Archiving of Files.
  • All images in your gallery will be edited by The Photographer including colour correction, tonal alterations, cropping and sharpening (where required). In some circumstances, The Photographer, may agree to carry out specific minor photoshop alterations where requested by the Client, but this may incur a fee for the additional time spent or outsourcing, where required. The Photographer does not edit all bodily imperfections in order to retain some authenticity. The Photographer does not provide clients with unedited or RAW files.
  • Once delivered, it is the responsibility of the Client to download digital files within the given timeframe and to arrange safe ongoing storage.  The photographer will keep copies of the digital files in archive, but this is not guaranteed to be indefinitely.  
  • Clients can request that galleries are un-archived and loaded to the online gallery at a cost of $75, payable in advance. If a purchase is made following unarchival, the $75 will be deducted from the total of the sale.


  • Quality of Products/Prints
  • Digital images will be provided in high resolution, suitable for printing, however, the photographer cannot be held responsible for the quality of printed images or products not completed by the photographer. 
  • The Photographer takes care to adjust and prepare digital files for the specific medium on which they are to printed, ensuring the highest quality. It is recommend that enlargements are prepared and printed by the Photographer to achieve the best results.


  • Complimentary Products
  • Where applicable, complimentary products (such as prints or sessions) cannot be transferred or exchanged for cash.


  • Co-operation
  • Whilst all attempts are made by the Photographer to encourage and engage all Participants to achieve the best possible images, the Photographer cannot be held responsible for 'missed' photos or sub-optimal content, where Participants have been unwilling or unable to cooperate.


  • Copyright, License of Use and Model Release
  • Copyright in all parts of all Photographic works created, remain the property of The Photographer. Under the NZIPP Standard Photographic Terms and Conditions of Engagement the Client purchases a license to use the photographic works for PERSONAL USE ONLY.
  • Photographic works and are not to be used by the Client for commercial, business, competition or publication purposes without the written consent of the Photographer. The Client must not be alter Photographic works in anyway (including addition of filters) and where watermarks are present, they must remain visible.
  • Photographic works cannot be sold or given to any 3rd party by the client; nor can the Photographer sell the images to any third party without consent from the Client.
  • The Photographer retains the right to use the Photographic works for any of the purposes outlined in Section 2.4 of the NZIPP Standard Photographic Terms and Conditions of Engagement including, but not limited to, advertising, competitions and awards. The Client can request that specific images are not used on social media by notifying the Photographer in writing.


  • Privacy Statement and Protection of Protection of Personal Information
  • As part of completing the Booking, The Photographer may collect and retain personal information about the Client. The personal information may be used by the Photographer for communicating with the Client for any purpose relating to the Booking, direct marketing and in connection with these terms and conditions. 
  • The Photographer acknowledges their obligations under the Privacy Act 2020.
  • The Client authorises the Photographer to collect, retain, use personal information for these purposes.
  • The Client must advise The Photographer as to whether any material or information communicated to her is of a confidential nature. The Photographer will keep confidential material or information communicated to her in confidence for the purposes of the photography, except where it is reasonably necessary to enable The Photographer to carry out her obligations in relation to the Booking.
  • As part of creating the Photographic Works, the Photographer may collect and retain personal information about the Client. The personal information may be used by the Photographer for communicating with the Client for any purpose relating to the Photographic Works direct marketing and in connection with these terms and conditions.
  • Personal information collected by the Photographer shall be retained in the Photographer’s database. The Client may access and request correction of any of the Client’s personal information by contacting the Photographer.


  • Liability
  • The Client agree to hold harmless, The Photographer from any dispute in the event you/The Participant become injured during the session or while on the premises or location of the session. The Photographer will not be held liable for any injury incurred by you or your family, or any damage to your property during the photography session.
